Discussion

1.    Opposing Political Parties representing the Executive office and the Parliament

This is a serious issue of constitutional set up and the electoral process, in which the Parliament Election and the Presidential Election are separate, months or years apart, and the constitution allowing the President to be a political party leader – anyhow this cannot be addressed   unless the President of the State realizes where he/she stands and how to act upon constitutionally, since the constitution itself cannot request the President to withdraw the Party Leadership.  Even it does so the person occupying the presidency will work “underground” ignoring the constitution as it has happened with Maithripala Srisena in the present situation. There are ample proves that President himself has been responsible for impasses during the 3-year rule so that he could manipulate for his political advantage putting the country in peril. The present situation emphasizes that both the Presidential election and the Parliamentary election are held together on the same day. If it happens that if Parliament Election alone is being held, in the present scenario, we will return to Square 1 as it is now, since we cannot predict who the winner is, unless anyone calling this Parliamentary election alone intends to win it by con or crook  swindler means, main reason for snatch – switching  the power beforehand!

2.    One Political Party A not respecting or accepting the clear Majority of another Political Party B

Since 2003 Political Party B suffered at the hands of Political Party A twice, despite Political Party B
has had the majority in the Parliament and at both instances, Political Party A was at the helm of Executive, one before the 19th Amendment and the latest one after the 19th Amendment. It should be mentioned here the 19th Amendment Itself has been an investigative arrangement stemmed out the behaviour of the members of the Political Party A in the past and of course to avert the repeat of 2003 occurrence of dismissing the Parliament session before the franchise mandated period 5 years that has been stipulated in the constitution. Hence the latest snatching of power and to dissolve the Parliament means a capitulation helps us to identify the people who have Hitlerism within their mindset, who are prepared to put the public and the country in absolute peril to be in the power, in contrast to their false democratic face. This behaviour of not respecting or accepting the clear Majority of another has no cure even in the Supreme Court or Appeal Court. Bewilderingly these group of people claiming to be fundamental Buddhists, begin their political activities, from Buddhist Vihara, do not want to follow Gautama Buddha’s teaching of easiest means of resolving problems.

2.    One Political Party A not respecting or accepting the clear Majority of another Political Party B continues, instead of 3.

Mobilize trade unions that can cause heavy damage to public day to day life frequently and the impact is manipulated and portrayed as an inability of a government, are such cruel that deaths and sufferings immaterial to them. Their usual rhetoric are “foreign intervention”, “Treason”, Rata Parvatheema” - all nonsenses are signs of not accepting the majority - in order to cut short the mandated period. But recently all of them including the president quoted many happening of the exotics as justification for their wrongful behaviors, President queried “if those countries can have a political problem why not we also have it” what a treacherous talk in front his party men. In all those countries majority is respected and at all such occurrences problems erupted when the majority became the minority, due to individual members resigning opposing the change of policy of the Majority Government –
Never an instance Head of Government swearing in a Minority Government despite a majority government is in the reign
In all those countries Franchise mandated period (most of them 5 years) for a mandated Policy through same exercise of Franchise, is respected and allowed go on for five years for that same policy is implemented and take shape, that is how all those countries development fast-tracked and never   cut shot the mandated period of the policy through connivance and manipulations to grab power.

Therefore if you all are true patriotic – allow a government with a mandated period for a particular policy and if the Policy is weak within that mandated period – end of mandated period - election will settle the issue – That is why all democratic countries have 5 year term for a mandated Government minimum universally whatever the reasons otherwise, In Sri Lanka the 19th Amendment have stipulated clearly the  means of dissolving Parliament and how to deal with, unlike the way President of the Party A did very arrogantly, undemocratically with absolute disregard to the constitution.

Bear in mind every election cost a colossal amount of money telling effect on the coffers.

3. Ignorance or not understanding the Democratic Principles

When Party B does not want to accept majority of Party A, the Democracy had been murdered blatantly, and all the actions of Party B becomes fooling the rural mass, by means of pompous talks and actions which require for them to rigorously control of electronic and print media, so that their fabricated stories, blatant lies, and ostentatious actions are not challenged by any means – Party A make sure that falsified dramas are reaching the gullible mass of the rural folk, because Party A always firmly believe that their voters can be easily fooled. Party A also requires to vigorously control the Judiciary so that their falsified actions not challenged and pigeonholed into the gullible mass. There was an attempt to fix the Judiciary by placing people who can easily be bought by Party A, and the Constitutional Council has thwarted it, just days ahead of the political unsettling was emanated.
Therefore present political anarchy sprang by just not ignorance or not understanding the Democratic Principles, but utter arrogance for seizing the power machinery for winning an election. That is using the democratic tool , the elections to be Autocratic.
Almost two decades period before 2015, we have experienced this autocratic rule and lived with that fearfully; are we going to a return to living with that frightening lawlessness through a parliamentary election alone?  Elections are just one tool of Democracy, and when a party emerges winner gaining more number than the other, and the loser with less number get the personal preference of the President, what is the benefit of the early election again or rather elections itself? Independent Judiciary, Media are the integral part of Democracy, that belongs to the Civics in order to exercise their Sovereign Franchise the tool of Democracy by summing up the truth; thus the election alone cannot be a democracy and the Judiciary or the media cannot be allowed to be owned by contesting Parties. Suppose  If the dissolving of Parliament has preceded the grabbing of power it would have portrayed different picture though it would have been challenged as well.

4. Un-Patriotic Greediness for capturing the Political Power

All that discussed above clearly vindicate Party A does not want to tolerate Party B getting winning position or finishing the full term, fearing policies of the Party B overhaul the voter basin. This cannot be allowed to occur repeatedly.

If Party A, polls 58 million votes and the Party B polls 62.5million votes – the policy of the Party A should be allowed a full term so that even civics among the 58million voted for Party A are as well benefitted, but it has become a practice of Party A keep on the Party A supports where they had been in their thinking instead of giving chance of one of either Parties’ policies attract each other, and that is the hallmark of Democracy, and that is how developments have been  fast-tracked  where absolute Democracy prevails in developed countries.

Unpatriotic greediness for political power may emanate various theories and claim that just another election will settle the issue, but as long as one Party is not accepting the majority of the other, can natural justice prevail in that society?

Conclusion/ Constitutional Approach

1.    Presidential Election and Parliamentary Election should be held together on the same day

2.    Parliament shall continue to be Supreme for all political activities, it has to function its full term as per stipulation of the constitution
3.    Parliament being Supreme shall remove the executive presidency system or
4. The Whole Parliament shall elect a President from Retired Sri Lanka Administrative Service who are distinguished of the service without any political alienation.
