Breaking the Deadlock Electoral Reforms for a Fresh Electoral Process

Two decade old demand shall be fulfilled through this National Unity Government, call for another national unity government is a permanently evading tactic.

Quite understandably the politicians are showing immense resistance to make a shift away from the present absolute proportionate representative system electoral system (PRS), a system that ensures a retaining of “seat” in parliament as well as hanging on to the parliament ruling party status. Strongly opposing minority parties are noticeably came into effect after PRS came into operation and were non-existent when First Past the Post System (FPPS) was the absolute criteria for electing of members and thus have no any experience in facing that type of election and are frightened at personal defeats, than anything else. Those minority parties, who clamor for more representation for them, were glamorously dining and dancing according music to the perpetrators whom vandalized the community they claim there are representing.
His Excellency and the Hon. Prime Minister shall closely scrutinize such organizations’ appalling appeals for more room within electoral process, just  to impasse the reforms and decide upon with the determined  attitude of a Nation as a whole, not for selfishness oriented clamors. Electoral process belongs to the people, and it is by the people, not for any political parties long before it is presented to the people however small or big they are. Political Parties shall demonstrate their wits and will to attract the people and voters rather than impasse progressive national rationale. It is not only irresponsible to claim that the voters do not need an electoral reform, but amounts to brand the voters as fools, as well.
If they cannot come in terms and successfully place them within the expanded scopes of

1    165 members from single and multi-member constituencies direct elections
2.       60 members from 22 electoral districts based on votes percentage accumulated from each electoral district off only looser votes count
3.       30 members based on the national percentage accumulated or best looser percentage based on the direct election of FPPS, they are not fit to be people’s representatives, through any process.

 United National Party Chief Whip’s claim that, electoral reforms that failed for 13 years and should be a failure through National Unity Government as well, is absurd and irresponsible claim being the main convener of the National Unity Government; the United National Party shall realize that the objective of convening a National Unity Government is to fulfill the civic demands that have been deadlocked for 20 years and failed by other governments. It has been pointed out by numerous educationists and civic societies the present electoral process is an antisocial mechanism, and it is the UNP government which enacted this more or less an autocratic electoral process, that makes the narrow minded selfish ends to be met so easily. The same UNP have been given a golden opportunity through a National Unity Government to rectify this once and for all, if they cannot rectify in this opportunity, it proves that they are all out in a witty mission of evading it forever.   Moreover it is the responsibility of the Independent Election Commission to evolve the more suitable electoral process of the country and recommend it to parliament, is the appropriate method in good governance, and again it is the UNP who broke that tradition as well.    Electoral reforms and originating electoral process is for the voters who demands it for more than 20 years and it is the responsibility of all political parties to favourably respond to it because it is voters who vote to elect their representatives using that process, having done that meet the people in an election to use your wits and knowledge to attract the voters in favour, that is the right spirit of all political parties!

The Political Cradle 2

Emotional reactions from concerned parties on Wilpaththu National Park issue is threatening to lead the country into a  state of commotion.

 I visited this park in 2004 as soon as it was first opened to public since 1985 by the then UNP government.
At the first hand the deposed President Mahindha Rajapaksha is the person who authorized the resettlement in the concerned area,  through  his autocratic style.  

Any area of 2 to 3 KM stretch surrounding the border of any Park is a sanctuary.  

But the same person MR had raised this issue for the cause he wanted to achieve politically ........and the vociferous wildlife lovers are reacting too emotionally after being kept silent by and during MR’s autocratic silencing! One exception was BBS

The wildlife lovers cannot except to change the things overnight, that has been a resettlement area for six years after the war ignoring and risking human habitation. Deposed leader had made a blunder in this and His Excellency Maithripala Srisena on course for correcting the damages and destruction caused to this oldest,largest and historically important national park of this tiny island. That is why most of the wildlife lovers are emotional and reactive, though some of them politically motivated. 
But the President quite rightly had effected a full stop to all degradation of park and adjoining sanctuary and had called for a report of the officials. Whatever the outcome of the report sanity and humanity should prevail for living human and biodiversity.
If it is found without any doubt that there is a human habitat within the sanctuary bordering the park,  suitable land should be allocated far outside the area to all those family by family  before ordering  the eviction and effecting it. Based on the experience I had as National Consultant Wildlife Veterinarian, to the Dept. of Wildlife and Conservation, any eviction order without alternative land for those who have been badly directed by the state itself would delay the eviction proper and practically it would be more threat to the wildlife diversity than in the prevailing situation.

This island nation’s agenda is more important than individual political Parties’ agenda, nor can be any individual

The country is in a crucial juncture that demands a new electoral process. Though not entirely new because two different practiced systems three decades apart, for the first time would be made to yield a single new parliament for a vibrant effective representation. The failure to adopt such a new electoral process to the very next parliament, would plunge the country into more troubled deep water. Time and time again this has been emphasized by many learned society as well as by civic society.
A formula of predominantly of First Past the Post System, that decide the proportionate representation from the balance of the cast vote shall emerge, it is hoped. Whatever the final formula the crossing overs to either side would erode the people’s verdict and swallow all the good effects of the entire system.

Therefore the present political situation of the country obviously demands a constitutional guarantee that ensures the People’s Supremacy and upholding the universal franchise to which Sri Lanka is proud for since 1931. It is recommended that, clauses should be included in the electoral section of the constitution, banning all the crossovers to any elected governing bodies, beginning from the day of nomination until within the final 45 days of the stipulated term of the particular elected body.

A parliament formed by the mixed electoral system of FPPS and Proportional Representation System, a Member of Parliament crossing over to either ruling party or opposition party before the 45 days of term, will be ceased to function as an MP and lose all the privileges installed upon becoming Member of Parliament through the either system. If it is a member through FPPS there should be a By-Election in the particular Electorate to fill the vacancy and if it is a PPR member, next in line in the Nationalistic List for the particular electoral district submitted to election commissioner along with the nominations for FPPS in order to select the Nationalistic MPS.  E.g. Vanni Electoral District has  3 electorates and all political parties in the fray mandated to submit 4 names of proposed National List MPs, whom need not necessarily  to be from the same district and thus termed as Nationalistic List MP, not in the real meaning of "National List MPs of 1978 constitution", who would contribute more towards nationalistic duties.
An independent candidate, who is successfully returned to an elected governing body, though shall hold the discretion of supporting either the party that forms the government or the opposition party, any member elected through a registered political party, cannot do so, but only through the sanction of the executive committee of the particular political party through which he/she or collectively has been elected. Anyway any member returned through a political party may become an independent member by rendering his resignation any time, from the political party elected him/her shall not join any other political party until 90 days of acceptance of his resignation by that political party, but it is the same political party’s discretion whether to apply the law of 45 days of term stipulation against that particular member even in this case. Any elected member who has been dismissed and or through disciplinary action by a political party, will cease to function as a member of any elected governing body, and lose all the privileges born by that elected body and will be barred from joining any other political parties, as well as contesting any election, until the very next election of the same elected body is over.

Stern exemplary actions be taken against, all of those (any) elected members who instigate, and participate in any violence during election, and indulge and violating the election laws should be arrested and remanded until the particular election is over through the proposed Independent Judicatory Commission – Election Commission combination; the same should be applied against those any Government Servants who are partial, fails to implement the election laws, being part of propaganda, and shall be removed from their office, stripping off the title he/she holds, imprisonment, and can mount up to freezing their property – this follows a study revealing most of the Government Servants actively involve politics to protect the ruling party in order to protect the wealth they have illegally accumulated during the period concerned, and they may become a part of toppling a democratically elected government as well.

For whose Benefit the Railway Time Table was changed? A Mafia in Place


It seems the change of time table to the Northern Sector from 1st of May 2015 is an outcome of a mafia in favour of wealthy Super Luxury bus owners against the commuter interests and comfort; there is a clear consorted effort by the Ministry of Transport to discourage the railway commuting, through many means which was historically far more enjoyable and comfortable, and was a joyful family affair.

As the first step of this mafia the popular historical names “Yarl Devi”& “Uttara Devi” have been removed from any form of publicity of CGR.

Department of Railways for no reasons feels sick about pronouncing those names of the  historical trains even through public addressing system of railway way stations and the services as well of those trains have been rendered discouraging to the commuters, by unnecessarily delaying at various stations for various silly reasons – and not given priority for long distance and the commuters are made to exhaust. 

The above time table found in the website of CGR not tallies with the ground operational situation and this reflects the lackluster approach of the officers regard the railway  operations; for example 4001 starts from Mount-Lavinia as early as 0500hrs and it is not publicly pronounced but has become a popular operation to the dislike of railway officials! Any way arrival time at KKS has been declared as 1200, but never reaches even Jaffna Station not even before 12.30. But earlier, I should say in even in1980s the Intercity Express sets off from Colombo Fort around 0700 hrs and was easily reaching Jaffna by 1230 hrs, why cannot do so now, - the reason is lackluster backstabbing approach by the entire system swallowed by heavily merchandised Intercooler AC bus operators.

When take up the new timing of trains 4078 and 4018 – which can be correlated to Yarl Devi and Uttara Devi respectively though cannot be even compared to those service rendered – scheduled to reach Fort Railway station at 15.30 and 16.30 but always late by few hours, and you can imagine how the collaborators have hatched out the plot to discourage the train travelling.  Already exhausted delayed train commuters would have to soak with the peak hour 1600hrs to 1800hrs rush of Pettah and Fort Commercial Hub area, to reach their actual destination from railway station! For whose benefit this new timing?

4089 Night Mail Train (NMT) has been deferred by one hour and twenty minutes, 20.40 from Fort which is scheduled to reach Chunnakam by 0550 hrs, this is a clear attempt to completely annihilate the restarting of 20.50 Express Train that operated in middle 1980s, just after the (NMT) those days.

 The main objective of (NMT) is deliver the postal service very next day through all the stations – within the train sorting out also took place to perform it in a perfect manner. How can a mail train reaching Jaffna as late as 0600 hours complete this job perfectly?  Why the Department of Railways have to step backwards when there is clear demand and there is stupendous avenues for improving the revenues of railways?

4090 NMT from Jaffna, (do not starts from KKS as advertised) has been provided with short distance engine, and it has to depend on the arriving express train engine for the journey, and if the express train is late, short distance engine has to carry out the job, and have to side change the engine twice, before reaching Colombo, a well plotted delay in favour of Travel Merchants!! 

And during good old days There was a time 40 years back I would board the Yarl Devi at 05.55 hours at Fort and get down at Jaffna station at 13.15 and if it is late never more than 15 minutes. If I board Uttara Devi, at Fort 11.55 hours I would get down at Jaffna station surely not later than 19.20, joining the family for dinner. Similarly the down train Yarl Devi and Uttara Devi left KKS at 5.55 and 11.55 respectively and reached Colombo Fort by 14.25 and 20.20 correspondingly regularly. No trouble of adding to the commercial hub peak hour rush transport difficulties.

The NMT those days started at 1800hrs from KKS and reached Colombo Fort at 0445 hrs to deliver the previous day mails to the addresses in Colombo or anywhere else in this tiny island nation; the UP NMT left Fort by 1920 hrs and reached Jaffna by 0445 hrs and KKS by 0545 to deliver the mails very next day,    These trains becoming late was a rare occurrence, but today this has become daily sickening affair.  Why the Department of Railways has to be submissive to road transport on the expense of commuter comfort and avenues for revamping revenues, which was the case just before 1986!

Better Stick on to Technology and Time table that gives more profit and comfort, that is the index of improving institution of a developing nation! 

There was time a villagers came to know the time by passing or arriving train, but today everybody have mobile phone, but this development nothing to do with the Department of Railways!
